Commonwealth Court Judge Johnny J. Butler upholds Sept 23rd, 2010 court decision to deny CPRB G-20 documents

“The issues before this Court include: 1) whether the authority given to the Board pursuant to the City’s Home Rule Charter supersedes the authority provided in the CHRIA; 2) whether the trial court erred by determining that a chronological listing of names of individuals charged with alleged offenses was protected from disclosure pursuant to Section 9106 of the CHRIA; 3) whether the Board’s failure to challenge the trial court’s information as compromising only protected intelligence, investigative or treatment information was an admission of such classification; and 4) whether the doctrine of judicial estoppel bars the City from repudiating the terms of a letter of understanding that memorializes the terms of the Board’s access to various investigative police documents. For the reasons that follow, we affirm the order of the trial court.”

Ms. Pittinger reported that the Board has not received a response regarding the CPRB appointment process (one vacant seat and the three incumbent expired member’s terms). To date, neither City Council nor the Mayor have acted as prescribed under the City Code, Title Six, Article VI, ยง662.04; A motion to conduct a Rude & Discourteous Hearing on Tuesday, January 31, 2012 was offered by Ms. Whitfield and seconded by Ms. Kramer, and approved unanimously; Ms. Pittinger briefed the Board on a video documenting a police/citizen encounter following a fatal shooting that occurred on November 14, 2011; Ms. Pittinger reported on CPRB’s appeal of Judge Wettick’s decision of 9/23/10; Ms. Pittinger acknowledged Solicitor Hugh McGough’s impending departure effective December 31, 2011.

Minutes of the CPRB Meeting Held on October 25, 2011 (Mtg. No. 140)

Ms. Pittinger updated the Board on the progression of the CPRB appointments in regards to the current vacancy and expiring member’s terms; Ms. Pittinger reported on the current status of Public Safety Bill No. 2010-0234, sponsored by Councilmen Burgess, Lavelle, and Shields; Ms. Pittinger informed the Board that the CPRB investigation into the Jordan Miles incident remains suspended pending the outcome of a criminal inquiry underway by the Allegheny County District Attorney, as is required by the Pittsburgh City Code.

Ms. Walker announced that Reverend Downing’s resignation is effective immediately following the meeting; Ms. Pittinger reported on the current status of Public Safety Bill No. 2010-0234, sponsored by Councilmen Burgess, Lavelle, and Shields; Ms. Pittinger mentioned Councilman Kraus’s concerns about including a provision in Bill No. 2010-0234 that would require data collection of the protected classes (gender, race, and disability), more specifically the LGBT community; Ms. Pittinger also noted City Solicitor Dan Regan’s assertion that the provisions of the proposed legislation would negatively affect the accreditation process; Ms. Pittinger informed the Board that the CPRB investigation into the Jordan Miles incident remains suspended pending the outcome of a criminal inquiry underway by the Allegheny County District Attorney, as is required by the Pittsburgh City Code.

Ms. Walker congratulated Solicitor McGough on winning the Republican/Democratic nomination for East End Magisterial District Judge. Mr. McGough will continue to provide legal representation to the Board for the remainder of the year; fulfilling the 2011 contract/agreement; Ms. Pittinger reported on the Appeal to Commonwealth Court regarding No. 2238 CD 2010. CPRB filed a reply brief on 5/16/11; Ms. Pittinger mentioned the current status of Public Safety Bill No. 2010-0234, sponsored by Councilmen Burgess and Lavelle; Ms. Pittinger reported on the PBP 2010 Annual Report that was released on 5/18/11; Ms. Pittinger updated the Board on the Jordan Miles case; Ms. Pittinger updated the Board on the progress of the impending vacancy and term expirations.

Ms. Pittinger mentioned the current status of Public Safety Bill No. 2010-0234, sponsored by Councilmen Burgess and Lavelle; Ms Pittinger explained the process for notifying the mayor and city council of CPRB’s impending exipiration of member’s terms; Ms. Pittinger announced the impending departure of Reverend Downing; Ms. Pittinger reported on a video documenting an incident involving a civilian and a Pittsburgh police officer at a Pirate baseball game on Saturday 4/9/11, which led to public controversy over the police officer’s conduct.
